Terms of Service

The Service

You agree and understand that Autofitech Services Private Limited (“AutoFi”) shall provide the following services to you:

  • record Payments made by you or by AutoFi on your behalf.
  • remind you about Payments as they become due.
  • make Payments on your behalf and with regard to making such Payments, AutoFi shall act as your Agent.

      Payments

      Payments mean non-cash payments to utilities (including but not limited to phone and electricity), credit card issuers, and service providers including but not limited to household help, tutors, trainers, etc.

      Terms of Service

      1. You agree and understand that AutoFi shall provide its services to you on a best-effort basis.
      2. While AutoFi shall make all efforts to accurately track, record, remind and make payments, it may, however, fail to do so for various reasons including but not limited to technical failures and change in dates and/or acceptable payment methods by billers and that AutoFi shall not be responsible for any loss or damage arising from such failures.
      3. AutoFi shall make Payments when you instruct AutoFi to make such Payments.
      4. You agree and understand that you shall pay AutoFi any amounts that AutoFi has paid on your behalf as Payments.
      5. You agree and understand that:
        1. AutoFi shall use the Bharat Billpay system, set up by the National Payments Corporation of India, to track the due dates and due amounts of all your service providers that are registered with Bharat Billpay. For all other service providers, AutoFi will use the information provided by you, to present due dates and amounts.
        2. AutoFi takes up to two (02) working days to process your instructions and make payments on your behalf to your service providers.
        3. It is your responsibility to provide timely payment instructions and keep AutoFi informed in case of any changes in your service providers details.
        4. AutoFi shall attempt to make all Payments correctly and on time; subject to you giving timely instructions. AutoFi will not be liable for late fees or any related liability in the event of a delay in payment or erroneous payments. In the event of an erroneous payment, AutoFi shall assist you to the best of its abilities in correcting the error.
      6. AutoFi may charge you a fee for providing this service. If you do not pay the fee, AutoFi reserves the right to terminate this agreement and stop providing the Service.
      7. AutoFi may charge you a penalty fee in the event that any payment request made by AutoFi to your bank is rejected for any reason whatsoever by your bank.
      8. Termination – Either you or AutoFi may terminate this Agreement, at any time. Any instructions for payments supported by the transfer of money to AutoFi that may be pending at that time shall be completed by AutoFi.
      9. AutoFi might use the information you provide to contact you for any kind of confirmation including but not limited to successful payments of your bills or for other promotional purposes.
      10. AutoFi might send you emails or SMS or messages on other messaging platforms including but not limited to Telegram and WhatsApp, about your account with respect to any transaction done.
      11. You agree and understand that AutoFi will have access to your financial information. AutoFi shall keep all information about you confidential to the extent that is reasonably possible and unless required to disclose it by law. You agree to abide by the Privacy Policy as mandated by the applicable laws in India [Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and sensitive personal data or information) Rules, 2011 to maintain the privacy of your Personal Data.       12. You agree and understand that AutoFi does not and shall not enter into contracts on your behalf with those providing services to you. Further, AutoFi is not and shall not be a party to the contract between you and your service providers. AutoFi is not responsible for adherence to or enforcement of any terms of conditions including payment terms and conditions in such contracts.
      13. You hereby certify that all recipients of Payments made by you through the Service are providing products and services that are compliant with the applicable laws of India.

      Prohibited Conduct

      By accessing or by availing the Services of AutoFi, you agree not to:

      • Violate the Terms and Conditions;
      • Impersonate any person or entity, falsely claim or otherwise misrepresent your affiliation with any person or entity, or access the accounts of others without permission and/or perform any fraudulent activity;
      • Infringe AutoFi’s or any third party’s Intellectual Property Rights or Privacy;
      • Use the AutoFi services if under 18 years of age without a parental sponsor;
      • Provide false, inaccurate or misleading information;
      • Breach this agreement or any other agreement or policy as may be applicable.

      Payment and Billing Information

      AutoFi might collect your billing name, billing address and payment method whenever you transact on any of the platforms hosted by AutoFi. AutoFi NEVER collects private information including CVV, PIN, passwords etc of your debit card or credit card.

      Third-Party Websites

      If you click on one of the links to third party websites, you may be taken to websites we do not control. This agreement and the policies referred thereto do not apply to the practices of those websites. Read the privacy policy of other websites carefully. We are not responsible in any manner whatsoever for these third-party sites.

      Jurisdiction

      This Agreement and related matters shall be governed by the laws of India and the Courts at Delhi shall have exclusive jurisdiction.

      Entirety

      This above constitutes the entire Agreement between the parties and supersedes any and all prior agreements, arrangements and understandings, whether oral or written, between the parties. No modification of this Agreement shall be binding unless in writing. Every provision of this Agreement is intended to be severable. All notices under this Agreement shall be in writing and shall be addressed to the appropriate addresses. 

      Fee Schedule For Bill Payment Services

      You agree and understand that AutoFi has two pricing plans. AutoFi reserves the right to alter these plans without providing prior notice.

      Details of the pricing plans are as follows:

      Basic Plan Membership

      Under this plan:

      • AutoFi shall not charge you a fee.
      • AutoFi shall:
        • record Payments made by you.
        • remind you about Payments as they become due.
      • AutoFi shall not make any payments on your behalf.
      Premium Plan Membership

      Under this plan:

      • AutoFi shall charge you a fee of Rs. 599 (Rupees Five Hundred and Ninety Nine Only) per month.
      • AutoFi shall:
        • record Payments made by you or by AutoFi on your behalf.
        • remind you about Payments as they become due.
        • make Payments on your behalf and with regard to making such Payments, AutoFi shall act as your Agent.
      • The Premium Plan Membership fee shall be charged at the beginning of each month.
      • You may choose to cancel your membership to the Premium Plan or to downgrade your membership to the Basic Plan anytime before and up to the date the bill for the fee is presented to you.
      • If you choose to cancel your membership to the Premium Plan or to downgrade your membership to the Basic Plan during a month after having paid the fees, no refund shall be payable for the part of the month where the Premium Plan membership is not availed by you.
